WHAT CHANGES TO DO IT IN 2020:
From 19 September 2018 in Italy the Legislative Decree 101/2018 entered into force, which changes the rules relating to the processing of personal data and, therefore, also to the Authorization to the processing of personal data in the CV. The measure aims to adapt the Italian legislation to the GDPR - General Data Protection Regulation, which came into force across the EU from 25 May 2018.

What changes with the entry into force of Legislative Decree 101/2018?
The Legislative Decree 10 August 2018, n.101 has established that consent to the processing of personal data in the CV is not due. This means that according to the new privacy legislation, it is no longer necessary to include consent to the processing of data in the Curriculum Vitae. Each candidate can freely choose to insert it or not.

What happens if you don't enter the authorization?
Article. 9, paragraph 1 c), of Legislative Decree 101 2018 establishes that, in the case of the receipt of CVs spontaneously transmitted for the purpose of establishing an employment relationship, the information referred to in article 13 of Legislative Decree 196/2003 , i.e. those concerning the methods in which the candidate's data will be processed, must be provided by the employer at the first useful contact, following the sending of the CV. This means that if the employer receives an unauthorized CV, he will have to request the authorization from the candidate by providing all the details on how the data is used. Only after receiving this consent can you use them.

DATA PROCESSING INFORMATION
Based on article 13 of Legislative Decree 196/2003, the person from whom the data is collected must receive the following information:
 - purposes and methods of data processing;
 - mandatory or optional nature of their provision;
 - consequences of a refusal to answer;
 - to whom the data will be communicated or who can learn about it, and the scope of dissemination of the same;
 - right of access to personal data and other rights provided by art. 7 of Legislative Decree 196/2003;
 - identification details of the owner and of any person in charge or persons in charge of data processing.


WHY IS IT USEFUL TO GIVE AUTHORIZATION TO DATA PROCESSING?

Although it is not mandatory to insert the authorization to process the data in the CV, it is useful to do so because the employer is immediately allowed to use his personal data to be contacted for an interview or to keep them for future selections.
Those who want to be sure that their data are used only for the purposes related to the selection and not for other purposes, can specify this choice in the wording (see as an example the third wording indicated above).
